I once read a news story about a man who went out drinking. Then he drove home. But on his way home, he got into a car crash and killed somebody. After the accident, he was tested for alcohol, and it was found out that he was below the legal limit. But he still had alcohol in his system, so he got charged for murder as if he was a drunk driver.

What do you think of this?

I think it's crappy.

it depends if he broke the law before he hit the person ie excessive speeding, ran a light/stop sign, but if it was just an unfortunate set of circumstances then murder is a bit harsh

If he was below the legal limit for being drunk, then I don't think he should be charged as if he was drunk.
