Nintendo have won against the low life scum who tried to steal creators art and claim if for themselves. Seems these clowns arms were too short to box with God.

Yuzu, a video game emulator, circumvents the Technological Measures and allows for the play of encrypted Nintendo Switch games on devices other than a Nintendo Switch. For example, Yuzu executes code that decrypts Nintendo Switch video games (including component files) immediately before and during runtime using unauthorized copies of Nintendo Switch cryptographic keys. Yuzu is primarily designed to circumvent and play Nintendo Switch games. In the ordinary course of its operation with those games, Yuzu requires the Nintendo Switch’s proprietary cryptographic keys to gain access to and play Nintendo Switch games.

Developing or distributing software, including Yuzu, that in its ordinary course functions only when cryptographic keys are integrated without authorization, violates the Digital Millennium Copyright Act’s prohibition on trafficking in devices that circumvent effective technological measures, because the software is primarily designed for the purpose of circumventing technological measures.

NOW THEREFORE, IT IS HEREBY ORDERED that:

  1. Plaintiff is awarded judgment against Defendant in the amount of US$2,400,000.

Anywho, not surprised it didn't go to court. Right or wrong, Yuzu just doesn't have the financial capacity to fight Nintendo.

The bit about a joint statement declaring that Yuzu does breach DMCA Copy protection laws (though not signed off by a judge at the moment it seems) sounds like it will give Nintendo free reign to...er...rain hellfire down on any other emulator (disclaimer: I am not a lawyer).

Nintendo didn't really win, both parties settle on agreement and both went home feeling better they can sleep better at night. Yuzu's biggest mistake was opening up a Patreon in the first place and had they kept themselves low-key, they would be still around.

Sure Yuzu could've stay on the road to court systems and probably would have won but that cost massively money and lawyers to do so. Settle on agreement was the best outcome for them.

@davillain: Nintendo didn't go after the Patreon, would have just made it worst though. Yuzu hired Lawyers to see if they could fight Nintendo but the Lawyers said they had no case. Lawyers told them to bend over and beg Nintendo for mercy.

Also, no Yuzu couldn't win, if they thought they could have it would have been cheaper to fight Nintendo then to pay them. They were getting 30k a month from Patreon alone. Plus they were making money off monetizing ads. Now them clowns making ZERO.

Yup. It doesn't surprise me they'd opt for settling. This is pretty much how it goes every time. Once Nintendo threatens legal action it's all over from there. I'm shocked they had that much money from Patreon though. They must have been saving it for just such an event.

Yup, just like I predicted. They didn't have the money to fight the bully in court. If they did fight then Nintendo would have lost. Sad to see how scales are tilted in corporations or rich's favor.

For Nintendo, some of the cost is probably not the game, but the expensive storage medium they use. But this means the download version should be a lot cheaper than it is now, for some reason it isn't.

I bet Yuzu's lawyers took one look at their internal emails, saw heaps of team messages like "lol let's update this to run pirated copies of Zelda better **** Nintendo yarrr", and told Yuzu that they'd lose.

It's truly a sad day for people who have dedicated their lives to game preservation. However, even under the shadow of Nintendo's anti-consumer strategies, a few methods still exist to enjoy Tears of the Kingdom at 4K 60fps.

This is a better way. No court ruling means Nintendo didn't really win. Switch emulators would still be up for the foreseeable future, especially when the time that Nintendo stops supporting the dinky little thing.

Nintendo didn't go after Patreon, they didn't even mention it in the case. They went after piracy and piracy only.

Yuzu has made a statement and realized their wrong doing.

But we see now that because our projects can circumvent Nintendo's technological protection measures and allow users to play games outside of authorized hardware, they have led to extensive piracy.

Also, got to love how surprised everyone is at this. Remember: Kotaku literally made an article on how to emulate/pirate Metroid Dread week of release. It got them banned from covering Nintendo products and somehow made Luke Plunkett and Sisi Jiang to promote racist anti-Japanese stuff on Twitter.

Probably the right move for Yuzu. Better than settings some fucked up precedent in court.

@mesome713: it doesn't matter...the code for yuzu is out in the wild and anyone can develop it. Nintendo needs to invest in proper hardware instead of bitching about the shitty hardware they chose being easily emulated by the steam deck and tons of mobile phones. It's frankly pathetic how the situation is. And even more pathetic is Nintendo continuing the path with switch 2 using shitty Nvidia arm cpus.

They would have only lost if they hired some sh*t tier lawyer or got one from the court whatever. Nintendo had no legal standing. It's simply a case of bullying because the opposite party can't afford high lawyer fees or spent years fighting in the court.

They weren't selling or even distributing pirated software or anything. What anyone else with the emulator does is not their responsibility.

Yeah, who was stealing and what were they stealing? Which IP was violated? Emulation isn't illegal, just like mods aren't illegal and yet R* shutdown the GTA mods because they can afford to fight the case but the poor people who made them can't.

If emulation was illegal then how come WINE or Proton is allowed? How come Valve is openly selling SteamDeck with Steam OS and Proton support? Why is MS not suing Valve or creators of Proton?

Good job being a sheep and fighting against your own rights on behalf of rich, disgusting, multibillion dollar corporations.

Terrible news. I haven't bothered trying yet, but hopefully there are still possibilities to play games such as Zelda TOTK, Bayonetta 3 and Metroid Dread in 4K/120fps?

Only Nintendo games I bothered with was Zelda BOTW and Bayonetta 1 (or 2 don't rem) but I believe those were Wii-U versions on a Wii-U emmy.

3M isn't even a drop in the bucket for cases like this. If Nintendo feels so confident then let let them take MS, Amazon or Google to court over this. All of these hosted/sold emulators that emulated Nintendo's devices.

Nope, the lawyers wouldn't be jumping on it because they will be the defenders in this case. The big payout opportunities exist where you're suing the party. All3 companies have hosted or sold emulators. Seems like Ninteno knows they can't bully them or out spend these companies.
